Shariah under Sovereignty: An Analysis of Judicial Reasoning in the Saudi Commercial Courts

Project description

This article attempts to unpack the conflict between applying Shariah and sovereignty in the Muslim world, from the prospective of Saudi Arabia where Shariah is followed most conservatively. Commercial court decisions are assessed based on the Islamic habitus concept. The difficulty arises due to the lack of malaka of the judges, which means education. The state interference to the Shariah sphere via legislation is also problematic to legal reasoning.
